Claims Handling BEFORE Suit

This course provides early-career attorneys and claims professionals with a broad understanding of the insurance claims handling process prior to a lawsuit or engagement of counsel. Participants will gain a basic understanding of the evolution of the insurance claim process over the past 30+ years. Participants will appreciate how conventional claims are handled on an everyday basis without litigation. This course will provide an explanation of key participants in the claims process, from policyholders and insurance carriers to examiners, adjusters, experts (engineers, accountants, estimators, etc.), contractors, and public adjusters. Should a conventional claim reach an impasse, additional participants may become involved. Participants will gain an understanding of the escalation process when a disagreement arises. Participants will gain an understanding of representation at the earliest stages of the claims process and the impact on that process, claimed scope, and loss value. Participants will be introduced to internal dispute resolution procedures managed by the carrier, as well as the Appraisal process. Participants will gain an understanding of the variety of expert services provided to claims professionals in the handling of conventional, non-litigated claims. Experts (building consultants, engineers, and forensic accountants) will share perspectives and experiences on a variety of claim types and issues that arise on non-litigated claims.
