When a vehicle exiting a multi-family apartment complex pulled out of a narrow alley onto a busy arterial roadway, it was struck broadside by an oncoming car. A passenger in the exiting vehicle sustained severe injuries and subsequently filed a lawsuit against the apartment complex, alleging that the property’s driveway and alley configuration created an unsafe condition for vehicles attempting to exit the site.

The allegations arising in the lawsuit, combined with historical approvals, long-standing safety complaints, and municipal determinations, created a complex factual record that required careful analysis.
